Libelo — Terms of Use

A short hello
We're Libelo, and we built this app for people who feel a little more alive when they're outside. Whether you came here to spot a kingfisher in the Biebrza marshes, find a quiet trail through the Sonian Forest, or just notice the trees on your street more — welcome. We're glad you're here.
These Terms of Use are the rulebook that lets us all share the app fairly. We've tried to write them like one human talking to another. They're still a contract, so the words matter, but you shouldn't need a law degree to understand what you're agreeing to.
If a section ever feels confusing, write to us at info@libelo.app and we'll explain in plain language.
1. Who we are
Libelo is operated by:

In these Terms we call ourselves "Libelo", "we", "us", and "our". We call you "you" or "the user".
2. What these Terms cover
These Terms apply when you download, install, open, or otherwise use the Libelo mobile app, our website at www.libelo.app, and any related online services (together, the Service).
By creating an account or using the Service, you confirm that you have read these Terms, that you understand them, and that you agree to be bound by them. If you do not agree, please don't use the Service.
These Terms work alongside two other documents:
- our Privacy Policy, which explains how we look after your personal information;
- our Cookie and Tracker Notice, which explains the SDKs and trackers used in the app and on our website.
Both are linked from inside the app and from our website.
3. Early Access — please read this
Libelo is in Early Access. That means the app is publicly available, but it's still being shaped by the first community of explorers — and by us, in real time.
What this means for you right now
During Early Access, the entire Service is provided free of charge. There are no subscriptions, no in-app purchases, no donations being collected, and no advertising shown. You don't pay anything to use Libelo today.
The Terms below describe how the Service works today and how it will work when we eventually introduce paid features, donations, or ads — so you can see the whole picture in one place. The sections about money (§ 11) only become active once we actually turn those features on, and we'll tell you in advance before that happens (see § 17 on changes).
You may encounter:
- bugs, glitches, or features that don't behave the way you expected;
- features that appear, disappear, or change between updates;
- temporary outages while we ship improvements;
- gaps in regional content (especially while we expand beyond Poland, Belgium, and the Netherlands);
- recommendations or maps that are incomplete or imperfect.
By using the Service during Early Access you accept that this is part of the experience. You also help us by reporting anything strange to info@libelo.app — every report makes the app better for everyone.
This Early Access notice does not reduce your statutory rights as a consumer. Under Polish and EU law, digital content and digital services — whether free or paid — must be in conformity with the contract, and we remain responsible if they are not. Early Access only limits what you should expect in terms of polish — not your legal rights.
4. Who can use Libelo
You can use Libelo if:
- you are at least 16 years old;
- you have the legal capacity to enter into a binding contract under the law that applies to you;
- using the Service is not prohibited where you live;
- you have not previously been banned by us.
If you're under 16, please come back when you're a little older. We've set this age limit because we use personal information to give you a thoughtful experience, and 16 is the standard age of digital consent in our launch markets.
If you use Libelo on behalf of an organisation (a school, a nature group, an employer), you confirm that you have authority to bind that organisation, and the Terms apply to it as well as to you.
5. Your account
You'll need an account to use most of Libelo. When you create one:
- give us truthful information;
- keep your login details private;
- choose a strong password — we recommend a unique passphrase with a password manager;
- tell us promptly if you suspect someone else is using your account.
You are responsible for what happens through your account. If you share access with someone else and they break these Terms, that is treated the same as you breaking them.
You can delete your account at any time from inside the app, in Settings → Account → Delete account, or by writing to info@libelo.app. Deleting an account also removes the personal information associated with it, on the timeline described in our Privacy Policy.
6. What Libelo does
Libelo helps you do two things:
- Spot. Record what you see in nature — plants, animals, places, weather, moments — together with photos, notes, and the location where you saw them. Build your own quiet log of the world, or share observations with the community.
- Discover. Browse curated routes, trails, and points of interest selected by us and by other explorers. The more you use Libelo, the better its recommendations get at matching what you enjoy: terrain you like, distances that fit your day, ecosystems that fascinate you.
During Early Access, every feature of Libelo is free. In the future, we may introduce paid plans, optional in-app purchases, donations, or advertising; the rules that will apply when we do are set out in § 11. Some features may also be available only in some regions.
We may add, change, or retire features from time to time. Where a change materially reduces the Service for paying users (once paid features exist), we'll either keep the affected feature available for the remainder of your paid period or refund a proportional amount.
7. The licence we give you
We give you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the Service for your own non-commercial use, in line with these Terms.
This licence is given to you by us, not by Apple or Google. The Apple App Store EULA or Google Play Terms of Service may also apply when you download the app from those stores; where they conflict with these Terms, those store terms prevail to the extent required by the relevant store.
8. Things you must not do
To keep Libelo a kind place, please don't:
- use the Service to break the law, harm anyone, or infringe anyone's rights;
- post content that is illegal, hateful, harassing, defamatory, sexually explicit, or harmful to children;
- post content that exposes the precise location of vulnerable wildlife (rare nests, dens, protected species — please blur, generalise, or omit the location for these);
- impersonate someone else or misrepresent your relationship to a place or species;
- harvest data from the Service by scraping, crawling, or automated means, except for accessibility tools you use yourself;
- reverse engineer, decompile, or attempt to extract the source code, except where the law explicitly allows;
- introduce malware, attempt to break our security, or interfere with how the app works for other people;
- use Libelo to send unsolicited commercial messages or to promote products and services without our written agreement;
- circumvent any limits, paywalls, geographical restrictions, or content moderation;
- resell, sublicense, or commercially exploit the Service.
If you spot something that breaks these rules, please report it through the in-app Report button or to info@libelo.app. We act on reports under our content moderation process and in line with the EU Digital Services Act.
9. Your content
When you upload photos, notes, observations, comments, route descriptions, ratings, or anything else (your Content), it stays yours. You own it.
To run the app, we need a licence from you to use your Content for the things the Service is built to do. So you give us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, copy, modify (only as needed for technical formats and moderation), display, distribute, and make available your Content strictly for the purposes of operating, providing, improving, and promoting the Service. This licence ends when you delete the Content or your account, except where we need to keep a copy:
- in our backups (which roll over within a reasonable period, normally up to 30 days);
- to comply with law or to defend legal claims;
- in anonymised, aggregated form that no longer identifies you.
Public contributions to the Libelo Community record. When you actively choose to make a piece of Content public — for example, by sharing an observation, photo, or natural highlight with the community — that Content becomes part of the Libelo Community record. For Content of this kind only, the licence you grant us above continues in respect of an anonymised version of the Content after you delete your account or the Content, on the basis described in our Privacy Policy (§ 8.1) and in the legitimate-interest exceptions to the right to erasure in Art. 17(3)(a) and Art. 17(3)(d) GDPR. The continuing licence is limited to the purposes of operating, providing, improving, and promoting the Service and the community record, and to public-information purposes consistent with those.
This continuing licence is always subject to your right to ask us to delete any specific public contribution at any time, by writing to info@libelo.app or using the in-app "Delete this contribution" option. We will not refuse such a request on the basis of this clause.
When we keep a public contribution after account deletion, we attribute it as "Anonymous contributor" or with no attribution; we do not credit Libelo as the author of your Content.
You confirm that:
- your Content is yours, or you have the right to share it;
- your Content does not break anyone else's rights (including copyright, trademark, privacy, or image rights of people in photos);
- you have the right to grant us the licence above, including the continuing licence over anonymised public contributions described above.
We may remove Content that breaks these Terms, applicable law, or our community guidelines. Where the law requires it (notably under the Digital Services Act), we'll tell you why and how to challenge our decision.
10. Other people's content and our content
Libelo's design, code, name, logo, curated routes, editorial content, illustrations, and aggregated data are owned by us or licensed to us. You can use them only as part of normal use of the app.
Other users' Content belongs to them. Don't copy, repost, or reuse it without their permission.
Some content in the app comes from open data sources (such as OpenStreetMap, GBIF, Natura 2000, public domain biodiversity datasets). These are credited inside the app and used in line with their licences.
11. Money — purchases, subscriptions, donations, and ads
11.1 Today: the Service is free
While Libelo is in Early Access, the Service is provided to you free of charge. There are no paid plans, no in-app purchases, no donations being collected through the app, and no advertising. You will not be asked to pay anything to use Libelo today.
The remaining sub-sections below describe the rules that will apply if and when we introduce any of those things in the future. They take effect only once the relevant feature is actually turned on, and we will tell you in advance before that happens, in line with § 17.
11.2 If we introduce paid features in the future
If we later offer paid features — for example, an optional Premium subscription or one-time in-app purchases — pricing, what's included, and how to cancel will be shown clearly in the app before you ever pay.
Payments inside the app would be processed by Apple (App Store) or Google (Google Play) under their own terms; we would not see your card details. Donations, if introduced, would be processed by a payment provider such as Stripe under their terms. Currency, taxes, and applicable VAT would depend on the store, your country, and your billing address.
11.3 If we introduce subscriptions
If you ever take out a subscription:
- it would renew automatically at the end of each billing period at the then-current price, unless you cancel before renewal;
- you would cancel through your Apple or Google subscription settings (we cannot cancel for you, because we don't control the store billing);
- if a renewal price changed, the relevant store would notify you in advance as required by their rules.
11.4 Refunds and your withdrawal right (when paid features exist)
Under Polish and EU consumer law, you would normally have 14 days from the date of contract to withdraw from a digital services purchase, without giving any reason.
If you started using a paid digital feature immediately and asked us to begin performance before the 14 days were up, you would expressly consent to begin and acknowledge that you lose the right to withdraw once performance has begun (Art. 38 pkt 13 of the Polish Act on Consumer Rights). The app would ask you to confirm this clearly before you paid.
Where the right to withdraw still applied, you could use the model withdrawal form available at www.libelo.app/withdrawal, or write to us at info@libelo.app.
For refunds of any future purchases made through the App Store or Google Play, the relevant store's refund process applies. You can usually request a refund directly from Apple or Google. We'll always try to help — write to us if a store refund doesn't go through.
11.5 If we accept donations
If we ever accept donations through the Service, donations would be voluntary contributions to support the Service and would be non-refundable except where required by law.
11.6 If we introduce advertising
If we introduce advertising in the future, we would try to keep ads relevant and unobtrusive. We would rely on advertising partners (which would be listed in the Cookie and Tracker Notice) who may use limited information to choose which ad to show. You would be able to manage your advertising preferences in Settings → Privacy → Ads & analytics, and Premium subscribers (if a Premium tier exists) would not see ads inside paid areas of the app.
Until we turn advertising on, no ads are shown and no advertising data is collected.
12. Third-party services
Libelo may link to or integrate with third-party services — maps, weather data, scientific biodiversity databases, payment processors, push notification providers, analytics, ad networks, and others.
We choose partners we trust, but we don't control their services. When you use them through Libelo, their own terms and privacy policies apply alongside ours. We list our key partners in the Privacy Policy and the Cookie and Tracker Notice.
13. Recommendations, content, and safety — please read
Libelo is a tool that supports your time outdoors. It does not replace your own judgement, and it is not a professional adviser. Please read this section carefully — it shapes how you should use everything you see in the app.
13.1 Recommendations and AI output are informational only
Routes, trails, points of interest, species suggestions, identifications, descriptions, personalised recommendations, and any output generated by automated systems or artificial intelligence inside Libelo (together, Recommendations) are provided for general information only. They are not, and must not be treated as:
- professional botanical, mycological, or ecological advice;
- medical, toxicological, pharmacological, or veterinary advice;
- professional navigational, mountaineering, or search-and-rescue advice;
- legal advice on protected areas, hunting, fishing, or wildlife regulations.
You must independently verify any Recommendation before acting on it, using authoritative sources — official protected-area information, qualified specialists, field guides published by recognised authorities, and the emergency services where relevant.
Never eat, taste, touch, handle, prepare, administer, or medicate yourself, another person, an animal, or a plant on the basis of anything you see in Libelo. Misidentification of plants, mushrooms, animals, or substances can cause serious illness, injury, or death. If in doubt, do not act.
To the maximum extent permitted by Polish law, Libelo accepts no responsibility for any decision you take, or fail to take, in reliance on a Recommendation. The protections you have under Polish and EU consumer law are not affected by this clause (see § 14).
13.2 User-contributed content is not verified by us
Other users post photos, observations, identifications, route notes, comments, and other material on Libelo (User Content). User Content is created by other users on their own initiative and is not verified, endorsed, fact-checked, or moderated by us in advance. It may be inaccurate, incomplete, out of date, or misleading.
You should treat User Content as the personal account of the person who posted it — useful as a starting point, never authoritative. The disclaimers in § 13.1 apply to User Content with at least equal force: do not eat, handle, medicate, or take navigation decisions based on User Content alone.
We act as a hosting provider in respect of User Content within the meaning of the EU Digital Services Act (Regulation (EU) 2022/2065). Consistent with Articles 6 and 8 of the DSA, we benefit from the hosting safe harbour, we have no general obligation to monitor User Content, and we have no general obligation to actively seek out illegal activity. We do, however, act on notices submitted under our notice-and-action mechanism (see § 8 and § 21) and we cooperate with the authorities as required by law.
Nothing in this § 13.2 limits the rights you may have against the user who posted the User Content, or any rights you have under mandatory consumer-protection law.
13.3 Safety in the outdoors
- Mobile signal and GPS accuracy vary; do not rely on the app as your sole means of navigation in remote areas.
- Routes, trail conditions, weather, and points of interest can change without notice. Check official sources for protected areas, hunting seasons, weather warnings, and closures before you go.
- Some species and plants are dangerous, protected, or both. Don't touch, handle, or disturb wildlife. Follow local protected-area rules.
- Always tell someone where you're going and when you expect to be back.
- In an emergency, call 112 anywhere in the EU.
You use Libelo in the outdoors at your own risk. We are not responsible for what happens during your time outside, except where Polish law makes us responsible (see § 14).
14. Our responsibility — and its limits
We work hard to give you a Service that is safe, useful, and reliable. If we fail to meet our obligations under these Terms, we are responsible for the foreseeable losses that result, on the basis described in this section.
14.1 The Service is provided "as is" and "as available"
To the maximum extent permitted by Polish and EU law, the Service, including all Recommendations and any AI-generated output (see § 13), is provided "as is" and "as available". We make no warranties, representations, or guarantees of any kind beyond those that cannot lawfully be excluded under Polish and EU consumer law. In particular, and without limiting the previous sentence, we do not warrant that the Service will be uninterrupted, error-free, free of bugs or security vulnerabilities, complete, accurate, or fit for any particular purpose you might have in mind.
This § 14.1 does not affect your statutory rights as a consumer under the Polish Act on Consumer Rights (Ustawa o prawach konsumenta), including the conformity-of-contract rights that apply to digital services — whether they are paid for or provided free of charge in exchange for personal data — under Articles 43k and following of that Act.
14.2 Free Service during Early Access
While Libelo is provided to you free of charge (see § 11.1), you use the Service on a voluntary basis, and our obligations are calibrated accordingly: we exercise the diligence appropriate to a free, community-oriented Service in active development. This calibration applies without prejudice to the mandatory consumer-law rights that apply regardless of whether the Service is free or paid, including the conformity rights referred to in § 14.1.
14.3 What we are not responsible for
To the maximum extent permitted by Polish law, we are not responsible for:
- losses we could not reasonably foresee at the time you accepted these Terms;
- losses caused by events outside our reasonable control (force majeure), including network outages, store outages, or government action;
- content posted by other users or for third-party services linked from or integrated into the app (see § 12, § 13.2);
- decisions you take, or fail to take, in reliance on Recommendations or User Content, contrary to the disclaimers in § 13;
- losses caused by your own breach of these Terms;
- losses caused by your failure to follow the safety guidance in § 13;
- losses arising from your use of the app on a modified, jailbroken, or rooted device, or from your use of unofficial builds or modifications of the app;
- inability to use the Service caused by your network, device, operating system, or third-party software that we do not control.
14.4 Cap on our overall liability
Our total liability to you in connection with the Service, in any twelve-month period, is limited to whichever is the greater of (a) the amounts (if any) that you paid us in that period, or (b) PLN 500.
14.5 What is not capped or excluded
Nothing in these Terms limits or excludes:
- our liability for death or personal injury caused by our negligence;
- our liability for fraud or fraudulent misrepresentation;
- our liability for damage caused intentionally (Art. 473 § 2 of the Polish Civil Code);
- your statutory rights as a consumer under Polish or EU law, including the conformity rights referred to in § 14.1;
- any other liability that cannot lawfully be limited or excluded.
14.6 Time limit for bringing claims
To the extent permitted by law, any claim you bring against us in connection with the Service must be notified to us in writing within twelve (12) months from the date on which you became aware, or with reasonable diligence ought to have become aware, of the circumstances giving rise to the claim. Claims notified after this period may be time-barred. This § 14.6 does not shorten any longer limitation period that mandatory Polish or EU consumer law guarantees you, and it does not apply where the law prohibits a contractual time limit for the claim in question.
14.7 Business users
If you are using Libelo in the course of a business (rather than as a consumer), the consumer-specific protections in this § 14 do not apply to you, and the liability cap in § 14.4 is your sole remedy.
15. If your content or actions cause us a problem
If a third party brings a claim against us because of:
- (a) Content you posted — including, without limitation, claims that your Content infringes someone else's copyright, trademark, database rights, or other intellectual property rights; that it infringes a person's right to their own image (prawo do wizerunku under Art. 81 of the Polish Copyright Act), right to privacy, right to protection of personal data, or personality rights; that it is unlawful, defamatory, or harassing; or that you posted it without the consents required by law (for example, the consent of a person photographed by you, or the consent of a parent for a minor in a photo);
- (b) your use of the Service in breach of these Terms, including breach of the safety and reliance disclaimers in § 13; or
- (c) your breach of applicable law while using the Service,
you agree to cover our reasonable costs of dealing with it (legal fees, damages, settlement amounts).
We won't ask consumers to cover claims that aren't their fault — this clause only applies where the claim arises from your own breach or your own Content.
We'll tell you about any such claim promptly, give you the chance to be involved in defending it, and not settle it in a way that admits fault on your part without your consent.
16. Suspending or ending your access
You can stop using Libelo and delete your account at any time.
We may suspend or end your access to the Service if:
- you break these Terms in a serious or repeated way;
- we are required to do so by law or by a competent authority;
- it is necessary to protect other users, third parties, or us.
Where we end your access, we'll tell you and explain why, except where telling you would itself be unlawful (for example, where law enforcement asks us not to). You can challenge our decision through the contact channels in § 21 and, where the DSA applies, through the out-of-court dispute settlement bodies referenced there.
When access ends:
- the licences you gave us under § 9 in respect of Content you have deleted come to an end (subject to the carve-outs in that section);
- the licence we gave you in § 7 ends;
- sections that by their nature should survive — including § 9, § 10, § 14, § 15, this § 16, § 18, § 19, and § 20 — survive.
17. Changes to the Service and to these Terms
The Service will change over time, and so may these Terms. We may update them:
- to reflect new features;
- to follow new law or guidance;
- to correct errors;
- for reasons clearly explained at the time.
We'll let you know about meaningful changes at least 15 days before they take effect, by email and inside the app. Small fixes (typos, formatting, clarifications that don't change your rights) take effect when we publish them.
If you don't agree with a change, you can stop using the Service and delete your account before the change takes effect. Continuing to use the Service after the change takes effect means you accept the new Terms.
18. Apple App Store users — additional terms
If you downloaded Libelo from the Apple App Store, the following additional terms apply, and override anything in these Terms that conflicts with them:
- These Terms are a contract between you and Libelo, not Apple. Apple is not responsible for the Service or its content.
- The licence to use Libelo is limited to use on Apple-branded devices that you own or control, in line with the Usage Rules in the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide maintenance or support for Libelo.
- If Libelo fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation.
- Libelo is not designed for use in environments where its failure could cause death or serious harm.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, with the right to enforce them against you.
- We, not Apple, are responsible for handling any claims relating to the app or your possession or use of it.
19. Google Play users — additional terms
If you downloaded Libelo from Google Play, your use is also governed by the Google Play Terms of Service. These Terms are a contract between you and Libelo, not Google. Google is not responsible for the Service or its content. We comply with the Google Play Developer Programme Policies.
20. Governing law and where disputes go
These Terms are governed by the laws of the Republic of Poland. The Vienna Convention on the International Sale of Goods does not apply.
Where you are a consumer, you keep the protection of the mandatory consumer-protection rules of the country where you live (Article 6 of the Rome I Regulation). This means a Belgian or Dutch consumer keeps the protections of Belgian or Dutch law in addition to what's in these Terms.
Where a dispute arises:
- we want to fix it. Please contact us first at info@libelo.app — most issues we can solve in a few days;
- if we can't, you can use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr to find a qualified out-of-court dispute body;
- in Poland, you can also use the Permanent Consumer Arbitration Court at the Trade Inspection Authority (Stały Polubowny Sąd Konsumencki przy Wojewódzkim Inspektorze Inspekcji Handlowej), or the Consumer Ombudsman (Rzecznik Konsumentów) in your area;
- if you take the matter to court, the courts of Poland have jurisdiction. As a consumer you may also bring a claim in the courts of your country of residence (Article 18 of the Brussels I Recast Regulation).

We aim to respond within 7 working days. For requests under data-protection law (GDPR) we respond within 1 month, as required.
22. The basics in plain language
If you only read one thing, read this:
- Be at least 16. Be kind. Don't break the law.
- Your photos and observations are yours. You give us permission to host and show them as part of running the app.
- Right now, Libelo is free — no ads, no subscriptions, no in-app purchases. If that ever changes, we'll tell you first.
- The app is in Early Access. Expect bugs. Tell us when you find them.
- Outdoors is wonderful and unpredictable. Use your own judgement; the app isn't a substitute.
- If we mess up, we'll make it right where we owe it to you under Polish and EU law.
